Terms & Conditions

Welcome to Mobany. By downloading, installing, registering for, or using the Mobany mobile application and associated services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms").

These Terms constitute a legally binding agreement between you ("User") and Mobany ("Company", "we", "us", or "our"). If you do not agree to these Terms in their entirety, you must not access or use the Platform.

To use Mobany, you must meet the following eligibility requirements:

• You must be at least 18 years of age
• You must have the legal capacity to enter into a binding contract in your jurisdiction
• You must not be prohibited from using the Platform under any applicable law
• Your account must not have been previously suspended or removed by Mobany for violation of these Terms

By registering, you represent and warrant that you meet all of the above eligibility requirements.

Registration

To access the Platform, you must create an account. During registration, you will be asked to select an account type: Professional (looking for work) or Business (looking to hire).

Account Security

• You are responsible for maintaining the confidentiality of your login credentials
• You must notify us immediately at support@mobany.com if you suspect unauthorised access to your account
• You are responsible for all activities that occur under your account
• You must not share your account credentials with any third party

Accurate Information

• You agree to provide accurate, current, and complete information during registration
• You agree to keep your profile information up to date at all times
• Providing false or misleading information may result in immediate account termination

If you register as a Professional, you agree to the following additional terms:

• Your profile, including photos, videos, and CV, will be visible to Business users when your availability toggle is turned on
• You must enable location services for your profile to appear in location-based search results
• You may upload a maximum of 5 images and 3 videos to your profile
• All uploaded content must accurately represent your own skills, identity, and professional history
• A paid subscription is required for your profile to be discoverable by Business users
• You are solely responsible for all information in your profile and any representations made to businesses
• Mobany does not guarantee any job offers, interviews, or employment as a result of using the Platform

If you register as a Business, you agree to the following additional terms:

• You may browse Professional profiles and filter results by category, state, radius, and gender
• You may initiate conversations with Professionals via the in-app messaging system
• You must not contact Professionals for purposes unrelated to legitimate employment or hiring
• You are solely responsible for any hiring decisions made based on information viewed on the Platform
• Mobany does not conduct background checks or verify Professional credentials — due diligence is your responsibility
• You must not use contact information obtained through the Platform to solicit Professionals outside the app
• Business accounts are free to create but subject to fair use policies

Subscription Requirement

A paid subscription is mandatory for Professional users who wish their profiles to appear in search results. Business users may access the Platform without a subscription.

Plans & Pricing

• Monthly Plan: $20 per month, billed every 30 days
• Yearly Plan: $100 per year, billed annually (best value)
• Pricing is set and may be updated by Mobany Admin at any time with reasonable notice

Billing & Renewals

• Subscriptions automatically renew at the end of each billing period unless cancelled
• You authorise us to charge your payment method on a recurring basis
• All prices are in USD and exclusive of applicable taxes

Cancellations & Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period — no partial refunds are issued
• Refunds will only be considered for documented technical failures attributable to Mobany

Mobany provides an in-app messaging system to facilitate communication between Businesses and Professionals. By using this feature, you agree to:

• Only Business users may initiate new conversations; Professionals may reply to received messages
• Messages must be professional, respectful, and relevant to employment or hiring purposes
• You must not send spam, unsolicited promotions, or repeated unwanted messages
• You must not share personal contact details (phone numbers, email addresses) to circumvent the Platform
• Both parties may delete conversations at any time from their chat list
• Mobany reserves the right to monitor messages for safety and compliance purposes

You retain ownership of all content you upload to Mobany (photos, videos, CVs, profile text). However, by uploading content you grant Mobany a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your content solely for the purpose of operating and promoting the Platform.

Content Standards

All content you upload must:

• Be accurate and not misleading
• Not infringe the intellectual property rights of any third party
• Not contain offensive, defamatory, discriminatory, or illegal material
• Not contain malware, viruses, or harmful code
• Comply with all applicable laws and regulations

Mobany reserves the right to remove any content that violates these standards without notice.

You agree not to engage in any of the following while using Mobany:

• Creating fake, duplicate, or impersonation accounts
• Scraping, crawling, or extracting data from the Platform by automated means
• Attempting to reverse engineer, hack, or compromise the Platform's security
• Using the Platform to engage in any illegal activity or facilitate unlawful hiring practices
• Discriminating against users based on race, religion, gender, nationality, age, or disability
• Posting job offers that are fraudulent, deceptive, or exploitative
• Using the Platform to advertise unrelated products or services
• Circumventing the subscription system through any means
• Interfering with the normal operation of the Platform or other users' experience

Mobany reserves the right to suspend or permanently terminate your account at any time, with or without notice, for:

• Violation of any provision of these Terms
• Behaviour that we reasonably believe is harmful to other users or the Platform
• Non-payment of subscription fees
• Provision of false or fraudulent information
• Legal or regulatory requirements

You may also delete your account at any time through your account settings. Upon account deletion, your profile and personal data will be removed in accordance with our Privacy Policy.

To the fullest extent permitted by applicable law:

• Mobany is a platform that facilitates connections — we are not a party to any employment agreement or hiring decision made through the Platform
• We do not verify the accuracy of user profiles, credentials, or claims made by Professionals or Businesses
• We are not liable for any loss, damage, or harm arising from your use of or inability to use the Platform
• We are not responsible for the conduct of any user, whether online or offline
• Our total liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Platform shall be resolved as follows:

• You agree to first contact us at legal@mobany.com to attempt informal resolution
• If informal resolution fails within 30 days, disputes may be escalated to binding arbitration
• You waive your right to participate in any class action lawsuit against Mobany
• Nothing in these Terms prevents either party from seeking injunctive or emergency relief

We may update these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Send an in-app notification or push notification informing you of the change
• For significant changes, request your renewed acceptance

Your continued use of Mobany after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and may delete your account.
